Lake Level Study

The study, as we understand it, is to determine how to establish 168 feet mean sea level as the minimum level at which to operate Toledo Bend during normal operations. (Three exceptions to the 168' msl have been well established).

Concerns:

· The Guide Rule Curve is treated as a contractual Document!

· Water/ Power Accountability during the Peaking Period!

· Apparent reluctance by the Authorities to recommend changing the Peaking Period!

· Peaking Power Vs. Peak Demand!

· The Review of the Power Sales Agreement will be cursory!

· Apparent concern by Authorities for meeting Bond Payments will hinder accomplishing the study's goal!

· Apparent concern by Authorities that changing the present system may jeopardize the Advance Power forgiveness schedule!

Recommendations :

· The Power Sales Agreement be reviewed in detail. With special emphasis on what unilateral operating decisions the Authorities may make and remain in compliance with the Power Sales Agreement!

· As is presently planned in the Step 2 Study, review the water data to determine potential modifications to water levels expressed in the Guide Rule Curve!

· Review water data and Power requirements by the Companies and determine if the Peaking Period can or should be changed!

· Count as Prime Power the 1st through the 65,700,000 KWH produced during the Peaking Period! Eliminate the present monthly accounting of Peaking Power!

· A Citizen advisory representative be allowed to attend and participate in future meetings of the Brown & Root panel and the Toledo Bend Project Joint Technical Board.
